TERRE HAUTE, Ind. (WTHI) – A Vigo County subdivision is one step closer to getting a wall built between their homes and a cluster of apartment complexes.
Attorneys for the Vigo County area plan commission and Viscaya Pointe subdivision scored a minor victory in court today. Cobblestone Crossings is fighting the commission’s order that it build a 10 foot wall between its apartments and Viscaya Pointe homes.
A similar wall exists between Cobblestone and Woodgate subdivision.
The judge denied a motion by Cobblestone, setting up a showdown over the wall.
“What they were wanting stricken from the record was some of the testimony on the record was the 2012 phase 3 approval by the commission, which included of course that the wall had to be constructed,” said James McDonald, Attorney for Viscaye Pointe.
Both sides will argue their case in court June 20.
