TERRE HAUTE, Ind. (WTHI) – Kyle Lutes, 24 of Terre and a graduate of Terre Haute South, was found on Feb. 8 in Palm Beach Gardens, Florida.
Just before 10:30 that morning a decomposed body was located just north of a fence line by an individual walking his dog.
After an autopsy on Feb. 9 it was determined the cause of death was a gunshot wound to the head. Police then ruled the case a homicide.
In the Probable Cause released by the Palm Beach County Sheriff’s Office, Lutes’ mother reported him missing on Jan. 26. Officials believe he was in Florida when he was killed in late January.
Lutes’ vehicle, which was also listed in the missing persons file, was located on Feb. 6. driven by Marisol Castro. She stated her brother Jay-Von Avery was borrowing the vehicle.
The Probable Cause states Avery’s other sister, Star Avery, was interviewed and admitted her brother confessed to her the he shot a boy and that he was down by the lake – that he had also been there since the end of January.
Jay-Von Avery, 21, was arrested Feb. 15 on preliminary charges of first degree murder.
He is scheduled for a jury trial July 9 in Palm Beach County, Florida. News 10 will continue to follow this case through the Florida court system.
Funeral arrangements for Kyle Lutes are set in Terre Haute for Feb. 21at 11 a.m. in DeBaun Funeral Homes Springhill Chapel.
Burial will be in Highland Lawn Cemetery.
Visitation will be at the funeral home on Thursday, Feb. 20 from 4 to 8 p.m., and also Friday from 10 a.m. until service time.
