WEST TERRE HAUTE, Ind. (WTHI) – A West Terre Haute bar now faces several charges after serving an underage male who later crashed into a car driven by a mother with her 8-month-old baby in the vehicle.

News 10 first reported the accident in March when officials reported Jacob Hubbard, 20 of West Terre Haute, failed to yield as he was traveling north on Mcllroy Avenue and crashed into a 2013 Nissan.

Both drivers had to be extricated from their vehicles by the Sugar Creek Fire Department.

After a two month investigation by State Excise Police, Highway 40 Sports Bar and Grill at 558 National Avenue now faces five charges.

Officials report Hubbard and Kristopher Hedden, 20 of West Terre Haute, went to the Highway 40 Sports Bar and Grill after they had already consumed 12 beers each.

Hubbard displayed his U.S. military ID to the bartender who did not check the age on the back.

Both Hubbard and Hedden ordered multiple drinks and shots of alcohol from the bartender who admitted knowing they were already intoxicatd.

Hubbard was arrested by West Terre Haute Police Department officers and faces charges of battery by bodily waste, intimidation, operating while intoxicated endangering a person and illegal consumption.

Hubbard’s case is set for trial by jury on June 23.

Highway 40 Sports Bar and Grill and bartender Chelsea B. Carter faces preliminary charges of sale of alcohol to a minor, allowing a minor to loiter and sale of alcohol to an intoxicated person.

Penalties could range from fines up to $5,000, suspension of the alcohol permit for a period of time or revocation of the alcohol permit.

“State Excise Police officers will continue to collaborate with local law enforcement to determine where intoxicated drivers were drinking,” Superintendent Matt Strittmatter said. “Locations found to have over served their customers will be held accountable.”

  1. So thankful that God was on our side. If it wasnt for God me and my baby could’ve been killed that night on our way home from church. But instead some injuries broken bone physical therapy etc. Im just praying Hubbard learned his lesson but if by chance he is reading this I wanna tell you that I forgive you but please don’t repeat your actions because the next people might not be so fortunate and you could kill them and their baby. God bless!
