Man sentenced for child abuse appeals

TERRE HAUTE, Ind. (WTHI) – A man sentenced for child abuse appeals his sentence to the Indiana Supreme Court.

Last month, the Indiana Court of Appeals overturned a 10 year prison sentence a Vigo County judge handed down to Larry Russell.

Russell pleaded guilty to child abuse charges.

Both the judge and prosecutor’s office felt Russell’s prison sentence had to be capped at 10 years despite the charges against him.

The court disagreed and ordered that Russell’s case return to Vigo County to be resolved.

Russell’s appeal to the Supreme Court delays that ruling.

Russell’s wife, Nikki, also received 10 years as part of a plea agreement.

Prosecutor Terry Modesitt has received notice that she has also appealed her sentence.
